Whistleblower Channel

Internal reporting system for the communication of irregularities, in accordance with Directive (EU) 2019/1937 and, as regards the Spanish companies of the firms, with Spanish Law 2/2023, of 20 February, regulating the protection of persons who report regulatory breaches and on the fight against corruption.

What is the whistleblower channel?

The Whistleblower Channel of the Jurisserv firms is the shared internal tool that allows employees, collaborators, clients and third parties to report confidentially any conduct that may constitute a breach of European Union law, of the applicable national law or of the internal rules and policies of the firms.

What can be reported?

  • Breaches of EU law in the areas set out in art. 2 of Directive 2019/1937 (financial services, prevention of money laundering, product safety, transport, environmental protection, public health, consumer protection, privacy and personal data, etc.).
  • Acts or omissions constituting a serious or very serious criminal or administrative offence, in particular in tax or economic matters.
  • Breaches of the internal rules of the Jurisserv firms (code of ethics, anti-money laundering policy, conflicts of interest, etc.).

How to report

The reporting person may submit the report in writing to the officer responsible for the internal reporting system at canaletico@jurisserv.com, or by requesting an in-person meeting at any of the firm’s offices. Anonymous reports are accepted provided they contain sufficient information to be assessed.

Safeguards for the reporting person

  • Confidentiality of the identity of the reporting person and of any third party named in the report.
  • Prohibition of retaliation against the reporting person for having reported in good faith.
  • Data protection in accordance with the GDPR and the applicable national legislation.
  • Acknowledgement of receipt within a maximum of 7 calendar days and a reasoned response within a maximum of 3 months.

External channels

Without prejudice to the internal channel, the reporting person may turn directly to the Autoridad Independiente de Protección del Informante (A.A.I.) or to the competent regional authorities in Spain, to the equivalent authorities of the other jurisdictions in which the Jurisserv firms operate, as well as to the institutions, bodies or agencies of the European Union.
